TreeKle Platform Terms of Use

Welcome to the TreeKle Platform (“TreeKle” or “Platform”). These Terms of Use (“Terms”) govern your access to and use of our services, features, and content provided through our website and mobile applications. By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. If you do not agree with these Terms, please refrain from using TreeKle.

1. Introduction

Welcome to the TreeKle Platform (“TreeKle”or “Platform”). These Terms of Use (“Terms”) govern your access to and use of our services, features, and content provided through our website and mobile applications. By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. If you do not agree with these Terms, please refrain from using TreeKle.

2. Definitions

“User”: Any individual who registers, accesses, or uses the TreeKle Platform, including TreeKlers (students) and Treeklites (contributors/supporters).

“Content”: Includes all data, information, text, graphics, images, videos, and other materials uploaded, downloaded, or appearing on the Platform.

“Services”: The features, functionalities, and programs offered by TreeKle, including scholarships, TreeKlup, marketplace transactions, and other tools.

3. Eligibility

Be at least 16 years old and have obtained parental/guardian consent if under the legal age of 18 years.

Provide accurate, truthful, and up-to-date registration information.

Comply with these Terms and applicable laws and regulations.

4. User Responsibilities

Use the Platform only for lawful purposes and in accordance with these Terms.

Maintain the confidentiality of their account credentials and immediately notify TreeKle of any unauthorized access or use.

Refrain from engaging in any activity that could harm or interfere with the Platform’s functionality, security, or other users’ experience.

5. Prohibited Activities

Use the Platform for fraudulent, harmful, or misleading activities.

Upload or distribute content that is offensive, defamatory, infringing, or otherwise unlawful.

Attempt to reverse-engineer, hack, or exploit any part of the Platform.

Create multiple accounts for deceptive purposes.

6. Services and Features

6.1 Scholarships: TreeKle offers scholarship opportunities to eligible users. Users must meet specific eligibility criteria and agree to the terms associated with the scholarship program.

6.2 TreeKlup: TreeKle’s crowdfunding feature allows users to create campaigns for financial assistance. Contributions made through TreeKlup are voluntary, and TreeKle does not guarantee campaign outcomes.

6.3 Marketplace: The Platform’s marketplace enables users to purchase goods and utilities securely.

6.4 Community: A space for users to engage, interact, and share experiences with one another.

7. Intellectual Property

TreeKle owns all intellectual property rights to the Platform, including its content, design, and software. Users are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes. Unauthorized use or reproduction is strictly prohibited.

8. Privacy and Data Protection

Our use of your data is governed by the TreeKle Privacy Policy. By using the Platform, you consent to the collection, use, and sharing of your information as described therein.

9. Termination and Suspension

TreeKle reserves the right to suspend or terminate user accounts without prior notice for violations of these Terms or other policies. Users whose accounts are terminated may be prohibited from re-registering or accessing the Platform.

10. Disclaimer of Warranties

TreeKle provides the Platform on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. TreeKle does not guarantee uninterrupted, secure, or error-free service.

11. Limitation of Liability

To the extent permitted by law, TreeKle and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform or inability to access it.

12. Indemnity

Users agree to indemnify TreeKle against claims arising from their breach of terms, unlawful activities, or misuse of the Services.

13. Dispute Resolution

Any disputes arising from these Terms shall be resolved through mediation before a licensed Mediator mutually agreed upon by the parties, failing which the parties may explore arbitration before a sole arbitrator in accordance with the rules of the Nigerian Arbitration and Mediation Act 2023 or any amendment thereto. The seat of arbitration shall be Lagos, Nigeria. Notwithstanding the above, either Party shall be at liberty to approach any Court in Nigeria for redress.

14. Modifications to Terms

TreeKle reserves the right to modify these Terms at any time. Users will be notified of significant changes, and continued use of the Platform constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
